Terms of Service

1. The service

brethof-brain is a hosted memory service for AI agents. It archives the conversations your agents send it, maintains a curated memory and memory graph derived from them, and makes all of it searchable by your agents through our client, plugins, and API. It is operated by Brethof AI (Poland).

2. Your account and keys

You need a Brethof AI account to create API keys. We strongly recommend enabling two-factor authentication on it — your memory is only as protected as the account that holds it — and when you turn it on it is enforced at sign-in. We do not require it: making access to your own data conditional on enrolling a phone would be worse. You are responsible for keeping your keys secret and for all activity performed with them; revoke a key immediately from your account panel if you suspect it is compromised. Keys may be shared among your own agents and machines — not sold, published, or provided to third parties outside your team.

3. Plans, allowances, and fair use

Each plan includes a monthly learning allowance (messages the memory service processes) and a storage allowance (total size of your memory on disk). Search and recall are not metered on any plan. When an allowance is reached, learning pauses until the next monthly period, an upgrade, or a top-up. We never delete your data because you reached a limit.

Moving to a smaller plan requires your stored memory to fit that plan's allowance first — free up space or keep a storage add-on until it does.

4. Billing

Paid plans are billed monthly (or yearly, where offered) through Lemon Squeezy. We do not see or store your card details. Promotional “founding member” prices stay in effect for as long as the subscription remains active. You can cancel any time from your account; your plan stays active until the end of the paid period. As a consumer in the EU you have a statutory 14-day right of withdrawal; by starting to use a paid plan immediately you consent to the service beginning before that period ends, and withdrawal covers the unused remainder.

5. Your data

Everything your agents store in brethof-brain is yours. We take only the limited license needed to operate the service for you: storing, indexing, and processing your content — including automated curation and summarization by AI models — solely to provide your memory. We do not train models on your content, sell it, or share it with anyone except the processors listed in the Privacy Policy. You can delete records, projects, old history, or your entire memory account at any time.

Processing on your behalf (GDPR)

Where your stored content contains personal data, you are the controller and we act as your processor under Article 28 GDPR, on the following terms, which form part of this agreement:

  • Instructions. We process your content only to provide the service as described in these terms and as directed by your use of it (storing, indexing, curating, recalling, exporting, deleting) — never for our own purposes.
  • Confidentiality. Access to customer content is restricted to what operating the service requires; the people involved are bound to confidentiality.
  • Security. We maintain the technical and organisational measures described on the Security page — including per-customer database isolation, encryption at rest under a per-customer key, and encrypted off-site backups — and we keep that page current as the measures evolve.
  • Sub-processors. We use only the sub-processors listed in the Privacy Policy, each bound by a data-processing agreement. We update that list before adding or replacing a sub-processor; if you object to a change, you may export your data and close your account before it takes effect.
  • Assistance. The export and deletion tools in your account exist so you can answer data-subject requests (access, portability, erasure) yourself, immediately; where they are not enough, we assist on request.
  • Breach notification. If we become aware of a personal-data breach affecting your content, we notify you without undue delay at your account email, with what we know and what we are doing about it.
  • Deletion at end. When your account ends, your content is deleted on the schedule in section 8, and its encrypted backups are deleted with it. Deletion is permanent and cannot be undone: we cannot restore a deleted account. Any remaining copies are erased as our backup systems cycle, within 30 days at the most. Deletion of the live data is cryptographic (see the Security page).
  • Information. We make available the information reasonably necessary to demonstrate these obligations; the Security and Privacy pages are the standing record, and specific questions get answered at [email protected].

6. Acceptable use

You may not use brethof-brain to:

  • Store or process content that is illegal in the EU or your jurisdiction
  • Attempt to access other tenants' data, probe, or overload the service
  • Reverse engineer the service
  • Resell access to the service itself (your agents and team may use it; the service is not yours to re-offer)

To be clear about what is not restricted: building your own product on top of brethof-brain is allowed and encouraged. An app that keeps its memory in your brethof-brain account — including one project per end-user of your app — is exactly what the service is for, and is not resale.

We may suspend accounts that violate these rules, with notice where practicable.

7. Availability

We operate the service with care — encrypted storage, isolated per-customer databases, monitored infrastructure, and nightly encrypted off-site backups — but self-serve plans come without a guaranteed SLA. If a disruption occurs, memory degrades softly by design: your agents keep working, and unsent history is written to disk on your machine and retried on the next turn, so a transient outage delays archiving rather than losing it. That buffer is bounded, so a long enough outage under heavy use can still drop the oldest turns. SLAs are available on Enterprise agreements.

8. Cancellation, retention and deletion

Cancel any time; your data remains available on the free tier's terms or until you delete it. Deleting your memory account removes your data from live systems immediately and deletes its encrypted backups with it; any remaining copies clear within 30 days.

Saved memories — single records or a whole project — can be deleted at any time. Raw conversation history works differently on purpose: agents act on your memory constantly, and one that misfires or is fed a malicious instruction should not be able to erase your past. So history is removed only in bulk, per project, and only the part older than 90 days; individual messages cannot be deleted, and the most recent three months is protected outright — it is what everything else can be rebuilt from. Deleting a project, or the account itself, is not subject to that floor. Details in the Privacy Policy.

If an account goes quiet. One schedule, and it is the same whether a free account stops signing in or a paid account stops paying. On day 7 the memory moves to encrypted cold storage — nothing is lost by archiving, and signing in or making any API call restores it automatically, in seconds. On day 23 we email you the deletion date, with a one-click link to download everything. On day 30 it is permanently deleted, backups included, and cannot be recovered by you or by us. Both days are counted from the day the account went quiet, not from archiving. Nothing is ever deleted silently: you are emailed when it is archived, a week before deletion, and once after.

When a subscription ends. An active subscription is never archived or deleted for being quiet, however long it sits. If a subscription lapses, the Brain pauses immediately — there is no grace period. Your memory is not deleted at that moment — the schedule above begins instead, and re-subscribing at any point before day 30 restores it automatically. The two are separate: the service stops at once, the data survives to day 30.

Your data, on demand. You can download your complete raw conversation history at any time from your account panel (“Download my data”) or via the API.

9. Liability

The service is provided “as is”. To the extent permitted by law, our total liability is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited under applicable law, or your statutory consumer rights.

10. Changes and law

We may update these terms; material changes are announced by email to account holders at least 14 days in advance. These terms are governed by Polish law. Questions: [email protected].
